Bill Text: PROPOSING AN AMENDMENT TO THE CITY CHARTER RELATIVE TO REVISION OF THE BOUNDARIES OF WARDS 4, 6, 7 AND 8
In the Year Two Thousand and Two RESOLVED by the Board of Aldermen of the City of Nashua that pursuant to RSA 49-B:5, the following amendment to the Nashua City Charter is deemed necessary and shall be submitted to the voters by placing it on the ballot at the next regular City election in the manner required by NH RSA 49-B with the following summary: Shall the municipality approve the Charter amendment summarized below? This charter amendment would adjust the boundaries of wards 4, 6, 7, and 8 to equalize the population of the wards for election purposes based on corrected 2000 U.S. Census data, as approved by the Mayor and Board of Aldermen under Resolution 02-82. Ward lines were adjusted by charter amendment approved by the voters at the November 2001 election, but incorrect census data resulted in unequal ward populations. This amendment would make the populations of the affected wards and other wards approximately equal as required by the Equal Protection Clause of the Fourteenth Amendment of the U.S. Constitution. City and Ward officers serving in office, or elected to office, at the time of passage of this resolution shall continue in said offices until the end of the terms for which they were elected. Amend Section 3 of the City Charter by deleting the struck-through language [example], and adding new language in bold italics [example] as follows: I. Ward 4: Beginning at the intersection of Amherst Street and the F.E. Everett Turnpike and running in a southerly direction along the centerline of said F.E. Everett Turnpike to the intersection of West Hollis Street; thence, turning and running in an easterly direction along the centerline of West Hollis Street to the intersection of Badger Street; thence, turning and running in a southerly direction along the centerline of Badger Street to the intersection of Kinsley Street; thence, turning and running in an easterly direction along the centerline of Kinsley Street to the intersection of Pine Ash Street; thence, turning and running in a southerly direction along the centerline of Pine Ash Street to the intersection of Lovewell Street; thence, turning and running in an easterly direction along the centerline of Lovewell Street to the intersection of Ash Street; thence, turning and running southerly along the centerline of Ash Street to the intersection of Nevada Street; thence, turning and running in an easterly direction along the centerline of Nevada Street to the intersection of Chestnut Vine Street; thence, turning and running in a southerly direction along the centerline of Chestnut Vine Street to the intersection of Lake Street; thence, turning and running in an easterly direction along the centerline of Lake RESOLUTION R-02-82 Street to the intersection of Main Street; thence, turning and running northerly along the centerline of Main Street to the intersection of Bowers Otterson Street; thence, turning and running in an easterly direction along the centerline of Bowers Otterson Street to the intersection of Harbor Avenue; thence, turning and running northerly along the centerline of Harbor Avenue to the intersection of East Hollis Street; thence, turning and running westerly along the centerline of East Hollis Street to Quincy Street; thence, turning and running continuing to run northerly across East Hollis Street and along the centerline of Spruce Street along the centerline of Quincy Street to the intersection of East Pearl Street; thence, turning and running in a westerly direction along the centerline of East Pearl Street to the intersection of Main Street; thence, turning and running in a northerly direction along the centerline of Main Street to the centerline of the Nashua River; thence, turning and running in a westerly direction along the centerline of the Nashua River to a point south of the intersection of the centerlines of Fairmount Avenue and Hillcrest Avenue; thence, turning and running in a northerly direction to the centerline of Fairmount Street; thence, turning and running in an easterly direction along the centerline of Fairmount Street to the intersection of Amherst Street; thence, turning and running in a westerly direction along the centerline of Amherst Street to the point of beginning. Ward 6: Beginning at the intersection of Main Street and Lake Street and running in a westerly direction along the centerline of Lake Street to the intersection of Chestnut Street; thence, turning and running in a northerly direction along the centerline of Chestnut Street to the intersection of Nevada Street; thence, turning and running in a westerly direction along the centerline of Nevada Street to the intersection of Ash Vine Street; thence, turning and running in a northerly direction along the centerline of Ash Vine Street to the intersection of Lovewell Nevada Street; thence, turning and running in a westerly direction along the centerline of Lovewell Nevada Street to the intersection of Pine Ash Street; thence, turning and running in a northerly direction along the centerline of Pine Ash Street to Kinsley Street; thence, turning and running in a westerly direction along the centerline of Kinsley Street to the intersection of Badger Street; thence, turning and running in a northerly direction along the centerline of Badger Street to the intersection of West Hollis Street; thence, turning and running in a westerly direction along the centerline of West Hollis Street to the intersection of the F.E. Everett Turnpike; thence, turning and running in a southeasterly direction along the centerline of the F.E. Everett Turnpike to the Daniel Webster Highway; thence, turning and running in a northerly direction along the centerline of the Daniel Webster Highway to Main Street; thence, turning and running in a northerly direction along the centerline of Main Street to the point of beginning. Ward 7: Beginning at the intersection of Main Street and Bowers Otterson Street and running in an easterly direction along the centerline of Bowers Otterson Street to Harbor Avenue; thence, turning and running in a northerly direction along the centerline of Harbor Avenue to East Hollis Street; thence, turning and running in a westerly direction along the center line of East Hollis Street to the intersection of Quincy Street; thence, turning and running continuing in a northerly direction along the centerline of Spruce Quincy Street to the intersection of East Pearl Street; thence, turning and running in a westerly direction along the centerline of East Pearl Street to the intersection of Main Street; thence, turning and running northerly along the centerline of Main Street to the Nashua River; thence, following the Nashua River to the Nashua City/Hudson town line; thence, turning and running southerly along the Nashua City/Hudson town line to the Sagamore Bridge; thence, turning and running in a westerly direction along the centerline of the Sagamore Bridge and the Circumferential Highway to the Boston & Maine RESOLUTION R-02-82 Railroad tracks the F. E. Everett Turnpike; thence, turning and running in a northerly direction along the tracks to a point at the centerline of West Brook Drive; thence, turning and running in a westerly, then northerly direction along the centerline of West Brook Drive to the intersection of Fairhaven Road; thence, turning and running in a westerly direction along the centerline of Fairhaven Road to the intersection of Farmington Road; thence continuing in a westerly direction along the centerline of Farmington Road to the F.E. Everett Turnpike to the intersection of the Daniel Webster Highway Main Street; thence, turning and running in an easterly northwesterly, then northerly direction along the centerline of the Daniel Webster Highway to the point where it intersects with Main Street and South Main Street; thence, continuing in a northerly direction along the centerline of Main Street to the point of beginning. Ward 8: Beginning at the intersection of Main Street, South Main Street and the Daniel Webster Highway and running in a southerly, then westerly southeasterly direction along the centerline of the Daniel Webster Highway to the intersection of the F.E. Everett Turnpike; thence, turning and running in a southerly direction along the centerline of the F.E. Everett Turnpike to the intersection of the Circumferential Highway; thence, turning and running easterly along the centerline of the Circumferential Highway and of (South) Main Street to the intersection of Farmington Road; thence, turning and running in an easterly direction along the centerline of Farmington Road to the intersection of Fairhaven Road; thence continuing in an easterly direction along the centerline of Fairhaven Road to the intersection of West Brook Drive; thence, turning and running in a southerly, then easterly direction along the centerline of West Brook Drive to the Boston & Maine railroad tracks; thence, turning and running in a southerly direction along the tracks to the Sagamore Bridge; thence, turning and running in an easterly direction along the centerline of the Sagamore Bridge to the centerline of the Merrimack River; thence, turning south and running along the centerline of the Merrimack River to the New Hampshire/Massachusetts state line; thence, turning and running in a westerly direction along the New Hampshire/Massachusetts state line to East Dunstable Road; thence, turning and running in a northerly direction along the centerline of East Dunstable Road to the F.E. Everett Turnpike; thence, turning and running in an easterly direction along the centerline of the F.E. Everett Turnpike to the Daniel Webster Highway; thence, turning and running north along the centerline of the Daniel Webster Highway to the point of beginning. II. This amendment shall become effective January 1, 2003. Notwithstanding any changes in the ward boundaries, the City and Ward officers serving in office, or elected to office, at the time of passage of this resolution shall continue in said offices until the end of the terms for which they were elected. Any elections to fill vacancies in the General Court shall be held on the basis of the ward lines as they existed for the election of November 5, 2002. Any representative or senator in office on the effective date of this act (January 1, 2003) does not lose his or her eligibility for that office because of the changes in ward boundaries made by this amendment.
