Bill Text: AUTHORIZING THE CHIEF OF POLICE TO SUSPEND OR REVOKE A PERMIT FOR AN EMERGENCY ALARM SYSTEM
O R D I N A N C E C I T Y O F N A S H U A In the Year Two Thousand and Two The City of Nashua ordains that Nashua Revised Ordinance, as amended, Chapter 17 “Police”, Article III “Emergency Alarm Systems”, Section 17-36 “Denial, suspension, revocation of permit”, be further amended by deleting the struck-through language and/or adding new language in italics as follows:: 1. Section 17-36(a) is hereby amended as follows: “(a) Failure to comply with any of the provisions of this article may constitute grounds for the chief of police to deny the issuance of a permit. or to suspend or revoke a permit issued under this article.” 2. Section 17-36(e) is hereby amended as follows: (e) At the hearing before the chief of police or his designee, the holder of the permit shall have the right to present evidence, to cross-examine witnesses, and to be represented by counsel. Such a hearing shall be informal and shall not be subject to the rules of evidence or formal courtroom procedure. After the hearing, the chief of police or his designee may either issue an order or of revocation, withdraw the notice of revocation, or suspend the permit until such time that he is satisfied that he the cause of the false alarms has been eliminated. or that the holder of the permit is in compliance with all provisions of this article.”
