| Bill Text: | GENERALLY AMENDING THE SNOW PARKING AND TOWING ORDINANCE AND REDUCING THE UNPAID NON-MOVING VIOLATION AMOUNT ALLOWED PRIOR TO TOWING DURING THE WINTER MONTHS In the Year Two Thousand and Three The City of Nashua ordains that Chapter 13 “Motor Vehicles and Traffic”, Article V “Parking and Stopping”, of the Nashua Revised Ordinances, as amended, hereby be further amended by adding the new underlined language and deleting the struckthrough language as follows: 1. In Division 4 “No Parking, Standing, Stopping in Specified Areas”, Section 13-285 “Parking during snow emergency; snow removal; posting of schedule; penalties”: “Sec. 13-285. Parking during a snow emergency or ,snow removal operations; posting of schedules; penalties. (a) No person shall park or leave a motor vehicle on any public way or in a public parking lot excluding city-owned parking garages during a snow emergency, as declared by the mayor or director of public works. Penalty for violation shall be a minimum of one hundred twenty-five dollars ($10025.00). Any vehicle left parked on any public way or in a public parking lot excluding city-owned parking garages during a snow emergency may be towed as directed by the chief of police, or his or her designee(s). (b) No person shall park or leave a motor vehicle on any public way in the city during snow removal or plowing operations. Snow removal schedules shall be posted in public ways at least three (3) hours before the snow removal operations are to commence. Penalty for violation shall be a minimum of fifty dollars ($50.00). Any vehicle which impedes the snow removal or plowing process may be towed as directed by the director of public works, or his designee, or by the chief of police, or his or her designee(s). Penalty for violation shall be a minimum of fifty dollars ($50.00). (c) No person shall park or leave a motor vehicle in a public parking lot during snow removal or plowing operations. Snow removal or plowing schedules shall be posted in public ways and in public parking lots at least three (3)eight (8) hours before the snow removal or plowing operations are to commence. Penalty for violation shall be a minimum of one hundred dollars ($100.00). Any vehicle left parked in any public way or public parking lot during snow removal or plowing operations may be towed or moved, as directed by the director of public works, or his designee, or by the chief of police, or his or her designee(s). Penalty for violation of this subsection shall be a minimum of one hundred dollars ($100.00) in addition to towing fees and all costs associated with towing. Said fine must be satisfactorily paid in full prior to the vehicle being released to its owner. After seven (7) days the vehicle will be subject to a storage fee of ten dollars ($10.00) per day. (d) The owner of any towed or moved vehicle is responsible for the cost of towing or moving fees and all other costs associated with towing or moving. Said fine must be satisfactorily paid in full prior to the vehicle being released to its owner. After seven (7) days the vehicle will be subject to a storage fee of ten dollars ($10.00) per day.” 2. In Division 8 “Violations and Penalties”, Section 13-353 “Unpaid non-moving violations; penalties”: “Section 13-353. Unpaid non-moving violations; penalties. (a) Between April 1 and October 31, Aany time an owner of a vehicle has unpaid non- moving fines totaling two hundred dollars ($200.00) or more, the owner will be subject to an additional fifty-dollar fine and all towing fees incurred. The owner’s vehicle will be towed and will not be released until the total fine is paid in full. (b) Between November 1 and March 31, any time an owner of a vehicle has unpaid non-moving fines totaling one hundred dollars ($100.00) or more, the owner will be subject to an additional fifty-dollar fine and all towing fees incurred. The owner’s vehicle will be towed and will not be released until the total fine is paid in full. All ordinances or parts of ordinances inconsistent herewith are hereby repealed. |
